陳情管道 Petitions Management

考試院為督促及協調所屬機關加強為民服務，有效處理人民陳情案件，特依行政程序法第170條第1項規定，訂定考試院及所屬機關處理人民陳情案件要點。本要點所稱人民陳情案件，係指人民對於行政興革之建議、行政法令之查詢、行政違失之舉發或行政上權益之維護，以書面或言詞向本院及各機關提出之具體陳情。

In an initiative to encourage and coordinate improved public services on the part of its affiliated agencies and their efficient handling of petitions, the Examination Yuan has drawn up, pursuant to the provisions of paragraph 1 of Article 170 of the Administrative Procedure Act, the Guidelines for the Handling of Petitions by the Examination Yuan and Affiliated Agencies. The guidelines address petitions made orally or in writing that concern concret matters and contain suggestions for administrative reforms, inquiries about laws and statutes, denunciations of official misconduct, or claims for protection of administrative rights.

人民陳情以書面為之者，應載明具體陳訴事項、姓名、國民身分證統一編號及連絡方式。人民陳情以言詞為之者，各機關應指派人員專責辦理，聆聽陳述後，收受有關資料並製作紀錄，並向陳情人朗讀或使其閱覽，請其簽名或蓋章確認後，據以辦理。

According to the guidelines, written petitions should note the specific details of the matter at hand, and include the name, ID number and contact details of the petitioner. Petitions made orally should be handled by an official appointed by the agency concerned, who will listen to the petitioner’s account, collect any relevant information, draw up the deposition in writing, read it back to, or have it read by, the petitioner for verification, then have the petitioner sign it or affix his or her seal. The petition shall then be handled according to the stipulated procedures.

各機關對人民陳情案件，應本合法、合理、迅速、確實辦結原則，審慎處理。並得視案情需要，約請陳情人面談、舉行聽證或派員實地調查處理。

Agencies are required to process petitions from the public with due care and attention, swiftly, reasonably and in accordance with the law. In addition and as may be required, agencies may interview petitioners, hold hearings or send personnel to conduct on-the-spot investigations.
