憲法中所規範之人民權利與義務
The rights and obligations of the people in our constitution

在憲法中，提到人民權利、義務，有「列舉式」及「概括式」兩種方式。

In our countrys constitution, there are two ways of mentioning peoples rights and obligations: "listing" and "generalizing."

「列舉式」規定指的是憲法第七條至第二十一條；「概括式」規定指的是憲法第二十二條。

The "listed" provisions refer to Articles 7 to 21 of the Constitution, and the "generalized" provisions refer to Article 22 of the Constitution.

人民的權利可分為四大類：平等權、自由權、受益權與參政權。這四大類底下，還有各種分類。

Peoples rights can be divided into four categories: equal rights, freedom rights, beneficial rights, and political participation. There are various classifications under these four categories.

由於權利與自由的範圍無邊，我憲法第二十二條採「概括規定」方式，對人民「其他自由及權利」，以不妨害社會秩序、公共利益為前提，均賦予保障。

Because the scope of rights and freedoms is boundless, Article 22 of our Constitution adopts the method of "general provisions" to guarantee the peoples "other freedoms and rights" without prejudice to social order and public interests.

不過，如果是為了防止妨礙他人自由、避免緊急危難、維持社會秩序、增進公共利益這些情況，仍然可以對人民的權利與自由，給予某些限制。這四種限制人民權利的情況，是憲法第二十三條明文列出的。

However, if it is to prevent hindering the freedom of others, avoid emergency dangers, maintain social order, and promote public interests, certain restrictions can still be imposed on the rights and freedom of the people. These four situations that restrict peoples rights are clearly listed in Article 23 of the Constitution.

人民的義務，依據憲法明文規定指出者，有三種：納稅、服兵役、受國民教育，其中，接受國民教育兼具權利與義務性質。

The obligations of the people, as stated in the express provisions of our Constitution, have three types: paying taxes, performing military service, and receiving national education. Among them, receiving national education has both rights and obligations.

此外，有關兩岸之間人民的權利義務關係，依據憲法增修條文第十一條的授權，制定「臺灣地區與大陸地區人民關係條例」為依據。

In addition, with regard to the rights and obligations of the people on both sides of the Taiwan Strait, the "Act Governing Relations between the People of the Taiwan Area and the Mainland Area" were enacted in accordance with the authorization of Article 11 of the revised Article of the Constitution.
