物權法的觀念源自英國，保障私有財產權才能確保每個人的權益。大陸是土地國有制，但「商品房」在法律上已確定是獲保障的私有財產，如果法律不能保證私有財產權，那購屋契約就如廢紙一張。
海南這件房地產官司的癥結點其實只有一個，就是私人物權能否受到保障！這個案子的第二段建物，建築隊只負責6到17樓的施工，其債權查封標的就應該只限6到17樓，沒有道理將6樓以下一起查封。
這也是一個很簡單的時間節點觀念，後面衍生的債務糾紛，不可以影響之前的完整物權。更何況，最早購屋之時，買賣契約俱在，交屋的產權證明也都清清楚楚。換句話說，這根本是兩個不同物主的物權，卻被建築隊硬扯在一塊。
台商在大陸投資置產的非常多，經常會遇到地雷，有些是自己沒有看清楚契約內容，有些是涉及產權分割不清楚。但海南這件案子很明顯是在胡攪蠻纏，只有期待法院做出公平裁判，才能挽回大眾的投資信心。
