大巨蛋停工爭議持續延燒，台北市府與遠雄互有攻防，宏道法律事務所律師蔡志揚表示，除了假處分，遠雄還可以走行政訴訟，向行政法院聲請「停止執行」行政處分。不過在走這管道之前，還是必須先走完訴願程序。

他也直言，行政法院通常比較保守，過去中科三、四期民間也曾提出要求停工，但通常通過機率較低。2010年，台中中科三期后里基地居民向台中高等行政法院提起行政訴訟，要求確認國科會與內政部發給的開發許可無效，最後敗訴。

蔡志揚說，遠雄另外還有一條路，就是向法院提出「保全證據動作」，由法官指派第三公正單位調查，釐清雙方責任。這同時也有個好處，就是萬一未來停工帶來工安問題，責任歸屬也比較好認定。

至於遠雄是否能訴求因北市府勒令停工，無法履約，甚至進一步提出假扣押，蔡志揚說，說假扣押多用在財產保全上，且因遠雄一定想表現自己是最想履約的一方，預期走上這步機率不大。

營建署副署長王榮進指出，市政府用《建築法》58條，要求大巨蛋停工，該法屬「事實認定」，只要建管單位去比對施工圖樣是否跟原先不符，就可以依法裁定。這個與中央無關。但他提醒，該法處分手段有好幾種，行政單位執行必須注意符合「比例原則」。
