（中央社記者楊淑閔台北17日電）日本熊本14、16日2次強震，災情慘重，行政院消費者保護處表示，震災發生前取消行程可依國外旅遊定型化契約辦理退費；但天災之後解約，因不可歸責於業者或消費者，狀況不同。

國人赴日旅遊頻繁，消保處消保官王德明表示，因為昨天才又發生強烈地震，日本災情慘重，「平安」為當下最重要之事，所以尚未聽聞有消費者申訴旅費爭議。

他說，「國外旅遊定型化契約」雖有規範出團前解約，依距離出發前時間不等有不同的退費標準，但是當有重大天災等不可歸責於消費者及業者的情況發生時，能否退費、如何退費等狀況就不一樣了。

消保處副處長吳政學說，交通部觀光局近日密集開會商議處理原則，希望別讓消費者全賠或業者賠本。

王德明分析，自助旅遊者的住宿費，不論已先付日本業者定金或多少費用，都須依日本法規處理；又當地災情嚴重、安危狀況不明下，災後若難以取得聯繫，消費者要有認賠的心理準備。

倘是跟團，已抵達日本，但行程無法走完，吳政學說，須依觀光局近日緊急召開的會議結論處理。王德明強調，當災嚴重至此時，平安最重要了，若是跟團抵達日彰化母親節蛋糕宅配本，旅行社應設法將團員帶回台灣。1050417
