法院认为，网络安全中心于2023年下达的命令，即要求TDC NET从其密集波分复用（DWDM）网络（一种用于扩展光纤网络容量的技术）中移除华为设备，构成征收性干预（expropriatory intervention），根据丹麦宪法，TDC NET有权获得全额赔偿。
法庭文件显示，华为公司于2011年首次为TDC NET公司的DWDM网络提供设备，并于2020年签署新协议以延长合作关系。但2021年生效的一项电信安全法赋予当局权力，可禁止此类协议以及禁止使用被视为构成国家安全风险的关键设备。
法院声明称，“高等法院特别强调，TDC NET自2011年以来一直本着诚信建设并维护着基于华为设备的庞大DWDM网络，而禁令实际上要求彻底更换该网络”。“此次干预措施专门针对TDC NET，且超出了常规监管范围。”
中国外交部发言人曾就相关问题回应称，肆意干预市场、违背经济规律的行为，非但无法获得所谓安全，还会付出巨大成本。事实已经证明，个别国家强行移除中国电信企业优质安全的设备，造成巨额经济损失，严重阻碍当地数字网络产业的发展。
