參、違反規定處分 Punishment Of Violation Rules I.應聘之勞工在契約期間內,如有下列情形之一者,僱主得予遣送返國,被遣送勞工之來回機票費用應由被遣送之勞工負擔,該費用若由雇主先行墊付,被遣送勞工應負責償還之責。 During the contract period, F.O.F the laborer, if any violation of rules committed, the employer has the authorization to send back home the worker. The round trip ticket by the worker himself/herself to be repatriated. If the ticket has been paid in advance by the employer, the repatriated worker should pay back this amount to the employer. 1. 攜眷來華者。 Bringing family members to R.O.C. 2. 受僱期間在中華民國境內結婚者。 Marrying someone in R.O.C. during the hiring period. 3. 工作專長與甲方所要求工種之必備技術不符者。 If the job and lack of skillful manner of the foreign labor does not fit the requirement of the employer. 4. 健康檢查不合格者或入境後在中華民國公立醫院健康檢查不合格者。(健康檢查應包括下列項目:X光肺部檢查、HIV抗體檢查、梅毒血清檢查、腸內寄生蟲糞便檢查,及其他經中央衛生主管機關指定之檢查項目)。 Failing physical examination in the public hospital of R.O.C.(Physical examination item including chest X-ray check, HIV antibody check, serum check for venereal disease, stool test for intestinal parasites, and other check-up items specified by the R.O.C. National Health Administration). 5. 在工作期間發現患疾病未能在一個月內治癒者。 If during the hiring period, he/she was discovered to have a disease or illness and which is not curable within a month. 6. 喪失工作能力者。 Loosing ability to work. 7. 受僱於非原簽約之雇主或從事兼業工作者。 Being hired by other than the original employer or working for a part- time job. 8. 有違公序良俗者。 Disobeying public order or undesirable conduct. 9. 違反中華民國法令者。 Breaking any stipulation of R.O.C. 10.不服從工作指揮,經三次發警告函者。 Disobeying working command and being issued three major warning letters. 11.無正當理由連續曠工三日,或一個月內總計曠工六日。 Continuing 3 days or accumulating 6 days in a month for cutting work without reasonable grounds. 12.申請文件有虛偽或不實情事者。 Giving false statements or inaccurate information, During application of papers and documents. 13.於訂立勞動契約時,為虛偽意思表示,使公司誤信而受損之虞者。 When establishing Employment Contract, the worker expressing hypocritical meaning. As a result, the company tempting to fall into false believing and suffering a loss seriously. 14.對公司負責人、各級業務主管或其他員工及其家屬,有恐嚇、強暴脅迫或重大侮辱事實者。 Committing threat, violence, or insulting seriously the company's president, general manager, supervisors in each hierarchy level or any other company members or their family members. 15.受有期徒刑以上刑之宣告確定,而未諭知緩刑或未淮易科罰金者。 Receiving sentence for a conclusive terms of imprisonment and not knowing if receiving a probation or reducing to a fine. 16.故意耗損機器、工具、原料、產品、或其他公物,或故意洩漏公司技術、營業上之機密,至本公司蒙受重大損失者。 Destroying machine, tool, raw materials, products, or any other public property deliberately or divulging make known secrets concerning company's technique or business. As a result, the company suffers a loss seriously. 17.無正當理由攜帶刀槍、械彈、爆炸物、毒品入廠者。 Bringing knife, guns, ammunitions, explosive or strong poisonous items into the factory without any reasonable grounds. 18.在廠區或宿舍聚賭並有事證者。 Gambling in the factory area or in the dormitory with concrete evidence. 19.在非吸煙區內吸煙者。 Smoking inside the company premises and in area that is marked as no-smoking. 20.工作上有重大過失,致公司蒙受損失者。 Committing a mistake during work seriously, thus damaging the company to suffer a serious loss. 21.吸食鴉片或其他毒品者。 Smoking opium or any other prohibited drugs and narcotics. 22.散佈不利於公司之謠言或文字,企圖挑撥勞資雙方感情,致公司蒙受重大不利者。 Spreading rumors or words that causes the disadvantage of the company, and attempting to urge and stir up labor wages or employee-employer relationship. As a result, the company suffers a serious disadvantage. 23.偷竊公私或同仁財物,經查屬實者。 Stealing robbing personal or public property after thorough investigation and examination as a concrete evidence. 24.違反勞工安全衛生規定,致公司與員工受嚴重損害者。 Breaking the Labor Safety and Sanitation Measures. There by harming seriously the company and employees. 25.私自結夥三人以上不上班或未依公司有關單位之規定核准,在廠內擅自聚眾集會者。 Participating in illegal organization or conducting a meeting by 3 or more gathering members to have absent without leave in the company and without following the stipulation of the relating unit in the company and its approval. 26.於廠外之任何不正當聚會,經治安單位或司法單位處罰有案者。 Conducting improper meeting outside of the company and afterwards penalized by the unit of the security or the administration of justice to have a record file. 27.進出工廠不接受警衛檢查,企圖強闖出入工廠且有偷竊物證者。 Not accepting the inspection of the police guard when entering and leaving the factory. Forcing its way in or out of the factory and having evidence of stealing or robbing. 28.在工作時間內,因擅離工作崗位或睡覺者。 Leaving work station by his/her own will or sleeping during work time. 29.在公司區域內毆打同仁或相互毆打者。 Hitting fellow workers or beating each other. 30.未經所屬處長級主管同意,擅自在廠區內如設計、製造、品管、工具機房內拍照致有洩漏公司機密之嫌疑者。 Without any approval of the supervisor, is not allowed taking pictures inside the room for planning, manufacturing, quality control and in the factory area by his/her own will. He/ she will to be responsible for his/her own airline ticket fare ; the contents for the warning orders is as follows: 因疏忽致機器設備或物品材料遭受損害或傷及他人者。 Damaging machine or destroying raw materials or hurting people because of carelessness. 在工作場所喧嘩、嬉戲、吵鬧妨害他人工作者。 Clamoring, playing, making loud noise in the workplace and disturbing other work. 未經許可擅自帶他人入廠參觀者。 Bringing other person into the factory to visit by his/her own will without approval. 投機取巧,隱瞞矇蔽,謀取非分利益者。 Using cunning method, concealing the truth, obtaining benefit that does not belong to himself/herself. 對同仁惡意攻訐、誣告、等製造事端糾紛者。 Making incidental remark because of finding others fault maliciously without truth forgery and spreading rumor. 在工作時間內於工作場所製造私人物件或唆使他人製造私人物件者。 Manufacturing personal materials in the workplace during work time or commanding others to manufacture personal materials for him/her. 未按規定穿帶安全裝備有具體事實者。 Not following the stipulation for wearing safety facility with concrete evidence. 塗寫牆壁機器,有礙觀瞻,且具體事實者。 Painting, writing on wall or machine and disturbing other work with concrete evidence. 需交接班之工作,未經報告主管,不俟交接完成,逕行下班者。 He/she not waiting for the person of the next shift to hand over the job, and leaving early from work without reporting to the supervisor. 委託或代人打卡者。 Asking other to punch for him/her or punching card for others. 將公司識別證借予他人或借用他人識別證進入公司廠區者。 Lending company ID badge to other person that is presently working in the company or borrowing company ID badge from another person to enter the company. 怠忽職守,致生變故,使公司蒙受重大損害者。 Shirking or Slowing down job responsibility that results in company damage. 藉故請病假往他處工作者。 Going to other place to work using sick leave. 在工作前或工作中酗酒滋事影響生產秩序者。 Drinking alcoholic beverage before and during work thus affecting the order of production. 遺失經管之重要文件、機件、物件或工具者。 Loosing important documents, machine items, materials or tools that the worker is in charge. 撕毀公文或公告者。 Tearing off and destroying documents or public announcement. 擅自變更工作方法致使公司蒙受重大損失者。 Changing work method by his/her own will. Thus, damaging the company. 拒絕聽從主管人員合理指揮監督,經勸導仍不聽從者。 Refusing to listen and comply with the reasonable directions and supervisions of the supervisor after warning him/her. 違反安全規定與措施致公司蒙受重大損失者。 Violating the company safety measures. Thus, affecting and damaging the company. 擅撥卡鐘或刷卡系統之時間者。 Damaging the punch clock and punch machine by his/her own will. 機器、儀器等具有技術性或危險性之工具,非經使用人員同意擅自操作者。 Operating machines, instruments, technical or dangerous tool by his/her own will without the approval of the user. 有偷竊、肇事、打架、賭博、簽六合彩、電動玩具等行為者。 Those who steal, causing trouble, fighting, gambling with vending machine and "Lottery". 員工交接班時,交待不清楚致操作錯誤,引起生產器具或產品損害、遺失者。 During shifting, when the working member does not hand over his/her task to the next person clearly and resulting in an operational error that causes the damage and loss of the product or the instrument manufacturing this product. 有違反相關法令或勞動契約之傷風敗俗行為者。 Making indecent behavior inside the company. Thus, violating the law or Employment Contract. 禁止帶頭滋事,反抗管理人員指導,煽動怠工、罷工等。 Leading the workers to cause trouble, revolting the administrator, becoming negligence in work, and orchestrating a strike. 其他重大違規行為者。 Any other serious untoward behavior violating the company's laws. II.有下列情事之一,累計三次發一次警告函: committing one of the following listed matter and accumulating it thrice, he/she is issued a major warning. 1.在工作時間倒臥休息,怠忽工作者。 Sleeping and resting during working time and negligence of. 2.因過失致工作發生錯誤情節輕微者。 Committing a wrongdoing at work because of a mistake with the condition not as seriously. 3.不依規定穿著服裝或佩帶規定標誌或穿拖鞋上班者。 Not wearing the company's with engrave "MARK" clothing according to the company stipulation or wearing slippers to work. 4.初次不遵從主管人員合理指揮者。 Not obeying the reasonable directions of the supervisor for the first time. 5.浪費公物,情節輕微者。 Wasting public property with the condition not as seriously. 6.檢查或監督人員未認真執行職務者。 During inspection or superintendent supervision, If found not diligently carrying his/her job duty. 7.在廠區內未佩帶識別證者。 Not wearing ID badge in the factory area. 8.初次遺失識別證者。 Loosing I.D badge for the first time. 9.出入廠區不遵守規定,情節輕微者。 Not following the stipulation when entering or leaving the factory area with the condition not as seriously. 10.未經許可攜帶不必要物品進入工廠者。 Without the permission of bringing unnecessary material in the factory. 11.不確實執行5S活動或破壞環境衛生者。 Destroying the sanitation of the surroundings. 12.上班前酗酒影嚮他人工作或在宿舍酗酒影響他人睡眠者。 Drunk before go to work or disturbing and effecting those people who wanted to sleep. 13.宿舍休閒器材(含乒乓球等球具),使用完後應確實歸回原位,違者罰 款NT$500元,故意破壞者,除賠償器具金額(雙倍)外,一律遣送。 The equipments in the dormitory leisure place (including billiards, table tennis tools), should be returned back to its original place, those violators shall be given a penalty of NT$500.-, if the violation is severe, he/she shall compensate the cost of the equipment's (2 times)aside from this, shall also be repatriated. 嚴禁於廠區、餐廳、宿舍隨地吐痰、便溺及亂丟垃圾,違者,罰款NT$300元。 Do not spit nor relieve oneself or litter anywhere else in the canteen factory area and dormitory: Those violators shall be given a penalty of NT$300.- |
